This disclaimer was created for the benefit of both the property owner and RMS
- To inform property owners of a potential risk that could result in unpleasant circumstances such as loss of use of a property, loss of sale of a property and/or litigation to resolve the situation.
- It also insures RMS will get equipment back if it does become stuck and will not be forced to pay for the process of doing so.
- Frankly, any contractor who does not inform you of this possibility is being less than professional.
Why is this document necessary?
- RMS cannot be held responsible if roots have grown into your system, something has been flushed down the system, equipment has been left in the line from a previous service provider (such as a broken snake, etc.) or if you have broken/rotted/defective pipe in your system. Furthermore, we cannot be held responsible for issues resulting from attempting to clear or inspect the system.
- RMS cannot be held responsible if a snake travels in an unintended direction as this cannot be controlled and may be the result of improper install of the piping system.
- The process of drain cleaning may involve the use of high-speed spinning steel cable and high-pressure water. Use of these methods may cause leakage and it is also possible that the snake may leave the pipe (especially in older/deteriorated pipe) and cause other damage outside of the drainage system.
In cases when RMS is hired by someone other than the property owner
(i.e., renter/leaser. potential buyer, realtor, etc.) By signing this form, you agree to act as the agent for the current owner of the property where work is performed and accept responsibility for the terms and conditions described above on the owner’s behalf. It is your responsibility to get acknowledgment of these terms from property owner before work begins or you may be held responsible.
